Terms of Service
Last updated: 11 August 2026
These Terms of Service (« Terms ») govern your access to and use of podgency.com and any content, resources, email courses, or services we provide (together, the « Services »). By using the site or subscribing to anything on it, you agree to these Terms. If you don’t agree, please don’t use the Services.
1. Who We Are
The Services are operated by Podgency, a registered business based in Tunisia. You can reach us any time at walid@podgency.com.
2. Use of the Site
You may use the site for lawful purposes only. You agree not to misuse it, interfere with its normal operation, attempt to gain unauthorised access to any part of it, or use it in any way that could harm us, our Services, or other users.
3. Free Email Course & Content
We offer a free email course and other educational content. When you opt in, you agree to receive the emails you signed up for and, where you’ve consented, occasional updates and offers. You can unsubscribe at any time using the link in any email.
Our content is provided for general educational and informational purposes. It reflects our own methods and opinions, is not guaranteed to produce any particular result, and does not constitute business, financial, legal, or professional advice.
4. No Guarantee of Results
Any examples, figures, frameworks, or outcomes shared through the Services are illustrations, not promises. Results depend on many factors outside our control — your market, offer, effort, and execution. We do not guarantee any specific outcome, revenue, or level of success from using our content or services.
5. Paid Services
Where we provide paid services, the specific scope, deliverables, timeline, fees, and payment terms will be agreed separately in a proposal, quote, or written agreement. In the event of any conflict, that separate agreement governs the paid engagement, and these Terms cover everything else.
6. Intellectual Property
All content on the site and within the Services — including text, copy, frameworks, roadmaps, worksheets, designs, graphics, and code — is owned by Podgency or its licensors and is protected by intellectual property laws. You may use materials we provide for your own personal or internal business purposes, but you may not resell, redistribute, republish, or claim them as your own without our written permission.
7. Third-Party Links & Tools
The Services may reference or link to third-party websites, platforms, or tools that we don’t control. We’re not responsible for their content, availability, or practices. Using them is at your own risk and subject to their own terms.
8. Disclaimer
The Services are provided « as is » and « as available, » without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t warrant that the site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Podgency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of — or inability to use — the Services, even if we’ve been advised of the possibility of such damages.
10. Indemnity
You agree to indemnify and hold Podgency harmless from any claims, losses, or expenses arising out of your misuse of the Services or your breach of these Terms.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and handle your information.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll revise the « Last updated » date above. Continuing to use the Services after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of Tunisia, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Services will be subject to the courts located in Tunisia, unless otherwise required by applicable law.
